IMPORTANT: These Terms and Conditions are a legal and binding agreement between you ("the User") and "crsh.fun". By accessing our site and using our services, you become bound by these terms. IF YOU DO NOT AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS, DO NOT USE OR REGISTER WITH THE SITE OR SERVICES.

Introduction

These Terms and Conditions state the grounds on which you can use and/or register with crsh.fun. Terms and Conditions are updated from time to time at our sole discretion and the most updated version is available on the site at all times along with the date of last revision.

We at crsh.fun provide matchmaking services consisting of recommendations and suggestions based on users' requirements (collectively, the "Services"). crsh.fun may offer additional services or revise any of the services, at its discretion at any future date in which case these Terms and Conditions shall apply to all additional services or revised services.

1. Eligibility Requirements

Minimum Age

Users of the site must be at least 18 years old to use or register at the site for the services. By using the services on the site, you represent and warrant that you are a minimum 18 years old.

Marital Status

By requesting to use, registering to use, or using the services, you represent and warrant that you are not married or are divorced. If you are not legally divorced, then the services will not be available for you until the divorce is legally achieved.

Criminal History

You represent and warrant that you have never been convicted under any law governing us or you. crsh.fun reserves the right to conduct a criminal background check at any time using available public records. By agreeing to these Terms and Conditions, you consent to and authorize such checks.

Verification Requirements

You authorize crsh.fun (and its third party authentication agency) to conduct verification checks on you. The verification process is critical for receiving the complete set of services offered at the site.

Important: Non-compliance with verification requests will render your registered account terminable at the instance of crsh.fun without any recourse.

Matching System Criteria

To register for the services, you must describe your partner preferences and respond to questions. This helps crsh.fun make recommendations of closest match in personality type and probable compatibility. There is a possibility that occasionally the matching system cannot identify high quality compatible matches, in which case we will not be able to provide the services.

2. Use of Site and Service

Exclusive Use

The account with the site is available under two categories: (i) Paid account; and (ii) Free User account. Once an account is created with the site it is for your personal use only. You may not authorize others to use the account. The account is non-assignable and non-transferable to any third party.

Geographic Limitations

The site and services are currently intended for users within India. The services and the site may be made open to other geographical locations and the same will be made known to users through notifications on the site.

Information Submitted

You are solely responsible for and assume all liability regarding:

  • The information and content provided at the site for the service
  • The information and content you post, transmit, publish, share or otherwise make available to crsh.fun
  • Your interactions with other registered users through the services
  • The information provided in the Personality Assessment

Risk Assumption and Precautions

All risks when using the services and the site, including but not limited to all of the risks associated with any online or offline interactions with others, including meeting other matches remain with you. You are expected to use your best judgement and agree to take all necessary precautions when meeting individuals through the site.

No Guarantees

crsh.fun attempts to provide matches on a best effort basis, however, every user may not find ideal matches through the services. We make no guarantees regarding the number or frequency of matches through the service, or your ultimate compatibility with matches you meet through the service.

3. Prohibited Activities

Zero Tolerance Policy

Abuse, trolling, inappropriate & objectionable content such as threats, nudity, obscenity etc. are an immediate violation of the Terms of Use and will result in strict action.

You will not post on the services, transmit to other users, communicate any content, or otherwise engage in any activity on the site that:

  • Promotes any kind of discriminatory material, racism, bigotry, hatred, or physical harm
  • Is intended to harass, annoy, threaten or intimidate any other users
  • Is defamatory, inaccurate, abusive, obscene, profane, offensive, or sexually oriented
  • Contains others' copyrighted content without prior approval
  • Contains video, audio photographs, or images of another person without permission
  • Promotes or enables illegal or unlawful activities
  • Is intended to defraud, swindle or deceive other users
  • Contains viruses, time bombs, trojan horses, or other harmful codes
  • Impersonates or misrepresents affiliation with any person or entity
  • Solicits gambling or engages in gambling activities
  • Collects personal information about anyone under 18 years of age

No False Information

You undertake not to provide inaccurate, misleading or false information to crsh.fun or to any other user. If information provided subsequently becomes inaccurate, you will promptly notify the site of such change.

No Commercial Solicitation

You undertake not to advertise or solicit any user to buy or sell any products or services through the site. You are strictly prohibited from transmitting any chain letters, junk or spam email to other users.

Penalty: Breach of this provision will result in liability of minimum INR 1,00,000.00 for each unsolicited communication.

Single Bona Fide Profile

As a registered user, you are expected to create only one bona fide profile. The use of the service must be for bona fide relationship-seeking/matchmaking purposes to maintain the integrity of the services.

4. Proprietary Rights

Ownership of Proprietary Information

You confirm and agree that crsh.fun is the owner of highly valuable proprietary information, including the patented compatibility matching system, compatibility profiles, and Personality Assessment (collectively, "Confidential Information").

License to Posted Content

By posting information or content to any profile pages or public area of the services, you grant unconditionally and in perpetuity to crsh.fun and its users, an irrevocable, perpetual, non-exclusive, fully-paid, worldwide license to use, reproduce, publicly perform, publicly display and distribute such information and content.

5. Privacy and Information Disclosure

Information Sharing

For providing our services, crsh.fun will disclose your profile information and verification results to recommended/suggested matches. Photos and other profile information posted by you will be available for viewing.

Disclosure By Law

You acknowledge and agree that crsh.fun may disclose information you provide if required to do so by law, including to:

  • Comply with law, requests or orders from law enforcement
  • Protect or defend crsh.fun's, or a third party's, rights or property
  • Protect someone's health or safety when harm or violence is threatened
  • For investigative purposes

Research Use

By using the services, you permit crsh.fun to anonymously use information from your experiences to continue research into successful relationships. Such research may be published in academic journals, but all responses will be anonymous.

6. Disclaimer of Warranty

IMPORTANT LEGAL NOTICE:

crsh.fun provides the services on an "AS IS" and "AS AVAILABLE" and "BEST EFFORTS" basis and grants no warranties of any kind. We do not warrant that:

  • The use of the services will be secure, uninterrupted, always available, or error-free
  • Any match resulting in marriage is of the highest compatibility
  • Any defects in the services will be corrected
  • The verification checks will meet your expectations

7. Limitation of Liability

To the maximum extent permitted by applicable law, crsh.fun will not be liable for any incidental, special, consequential or indirect damages arising out of or relating to the use or inability to use the services, including damages for failed marriages, outcome of verification checks, loss or corruption of data, even if crsh.fun knows or has been advised of the possibility of such damages.

8. Subscriptions and Payments

Payment Methods

You may make purchases through: (a) third-party platforms such as the Apple App Store and Google Play Store, or (b) paying with your credit card, debit card, or UPI, processed by a third-party processor.

Auto-Renewal

crsh.fun may offer services as automatically-renewing subscriptions. IF YOU PURCHASE AN AUTOMATICALLY RENEWING SUBSCRIPTION, YOUR SUBSCRIPTION WILL RENEW AT THE END OF THE PERIOD, UNLESS YOU CANCEL, AT crsh.fun'S THEN-CURRENT PRICE.

To avoid charges for a new subscription period, you must cancel before the end of the then-current subscription period. Deleting your account or the application does not cancel your subscription.

Cancellations and Refunds

You may cancel your subscription at any time during the term. If you cancel your subscription, you may use your subscription until the end of the period you last paid for.

All charges for purchases are nonrefundable, and there are no refunds or credits for partially used periods.

9. Term and Termination

These Terms and Conditions become effective upon your registration on the site and will remain in effect in perpetuity unless terminated. Either you or crsh.fun may terminate your account at any time, for any reason, effective upon sending written notice to the other party.

Important Termination Conditions:

  • In the event the account is terminated due to breach of these Terms, fees paid will be nonrefundable
  • Some information may remain archived with crsh.fun even after termination
  • Non-payment of renewal fees will indicate your desire to terminate your account
  • Termination shall not affect any liabilities incurred prior to termination

10. General Provisions

Governing Law and Jurisdiction

Any dispute or claim relating to these Terms and Conditions shall be governed by the Arbitration and Conciliation Act, 1996 by a sole arbitrator appointed by crsh.fun. The arbitration proceedings shall be held in English language at New Delhi. The courts at Delhi shall have exclusive jurisdiction over any disputes.

Indemnification

You agree to indemnify, defend and hold harmless crsh.fun, its affiliates, and each of their officers, directors, employees, agents for any losses, costs, liabilities and expenses relating to or arising out of your use of the site or services, any user postings made by you, or your violation of any terms of this agreement.

Communication

crsh.fun may use your email address & phone number to send SMS, WhatsApp messages & RCS notifying of important changes/updates to the services, special offers & One Time Passwords (OTPs). We may also contact you by telephone regarding the services. You can opt out at any time if you don't want to receive such communications.
